Martinez v. Beacon Wines & Mitchell’s Wines & Liquor (Funsan K. Corp., C.Y. New Corp.)

In July 2016, a former employee who worked as a stocker, floor employee, cashier and delivery employee at Defendants’ liquor stores filed a lawsuit in federal court in Manhattan for failure to pay minimum wage and overtime and other labor law violations. Specifically, Plaintiff alleges that he was paid a flat weekly rate that did not compensate him at minimum wage and did not provide overtime premiums even though he typically worked much more than forty (40) hours per week, and that Defendants improperly withheld a portion of his tips.
