Sumner v. Rojac Watchman Security Service

​In January 2016, four flaggers, helpers and laborers who worked for Rojac Watchman Security Service and MECC Contracting filed a complaint in federal court in Brooklyn seeking unpaid overtime and prevailing wages for work performed on public New York City roadways. Plaintiffs also allege that they were required to pay kickbacks from their wages to Defendants, in violation of New York Labor Law.

The parties have agreed to conditional certification of an FLSA collective of Rojac workers who worked on ConEd projects where MECC served as the general contractor at any time since January 19, 2013.
