Zamorano v. Bel Aire Diner

In November 2016, six cooks, kitchen helpers and delivery employees filed suit against Bel Aire Diner, a 24-hour diner located in Astoria, Queens. The Plaintiffs allege that they were paid a flat weekly rate that fell below minimum wage and did not include overtime premiums for hours Plaintiffs worked over 40 per week. Plaintiffs also allege that Defendants unlawfully withheld a portion of their credit card tips.
