The current budget of the U.S. Department of Defense is over $700 billion—the opportunity for fraud and abuse has long been recognized. One of the most powerful whistleblower laws, the False Claims Act, was enacted to address the problem of crooked contractors providing the Union Army with shoddy goods during the Civil War.

Big Money Means Big Opportunity for Fraud

The staggering sums spent by the Department of Defense and other Departments have spurred influence peddling, illegal campaign contributions, improper lobbying, and illegal job offers or other benefits to highly placed procurement and regulatory personnel. Here are some additional examples:

Product substitution–providing a product that does not comply with the contract specifications

Mis-vouchering–false certification that products meet government specifications or guidelines

TINA–to avoid lengthy bidding, companies can negotiate, but must comply with the Truth in Negotiations Act, which requires honest transparency

False or exaggerated billing or billing estimates made to government agencies or contractors who in turn bill the government

False or deceptive statements or reports to government agencies made in order to receive government contracts or other monies or to avoid duties or other charges

Any false or deceptive reports or filings that may endanger people, property or the environment
