What’s Happening?

A lawsuit called Arcos v. Sweeping Corporation of America, LLC has been settled. You may have received a notice about this in the mail. This settlement could affect your rights to claim unpaid wages.

Key Points:

  1. The settlement offers about $312 on average to each worker.
  2. If you accept this settlement, you give up your right to claim unpaid “prevailing wages” from SCA. Prevailing wages are higher pay rates for work on public projects. 
  3. The Arcos lawsuit didn’t actually include claims for unpaid prevailing wages. But accepting the settlement means you can’t sue for these wages later (which are significant).
  4. There’s already another lawsuit against SCA for unpaid prevailing wages. If you accept the Arcos settlement, you can’t be part of this other lawsuit.

What You Need to Do:

  • If you want to keep your right to claim unpaid prevailing wages, you must opt out of the Arcos settlement by March 24, 2025.
  • If you do nothing, you’ll get some money from the settlement, but you’ll lose your right to claim potentially much more money for unpaid prevailing wages.
